Eligibility date for ILR after FLR extension?

I entered the UK on a fiance visa in 2005; married in 2006; FLR granted in 2006 for 2 years -- applied for FLR extension in 2008 because of monetary restrictions because spouse had accident and major surgery and off work for 6 months -- extension was granted for 2 years and will expire in July, 2010. Must I wait until then to apply for ILR or can I apply before April 6 and pay the present ILR fee?
